Jakarta Internasional Container Terminal Tanjung Priok – Jakarta Menurut UU NO 5 Tahun 1999 (Studi Kasus Perkara Perdata Nomor : 02k/Kppu/Pdt/2014 Antara Komisi Pengawas Persaingan Usaha Melawan Pt. Jakarta Internasional Container Terminal)

In this scientific work, research is done at the port of Tanjung Priok Jakarta.
Aiming for there is an objective reason for the issue that the prohibition of
monopolistic practices and unfair business completition that has a disadvantage for
the masses and in order to guarantee the certainty of the business opportunity.
This research is normative law with type of descriptive research.
From the results of this study can be concluded service loading and unloading
container done by PT. JICT at the Port of Tanjung Priok there has been monopoly
practice and unfair business competition with the decision of KPPU in case initiative
No.14 / KPPU-I / 2013 dated January 5 , 2014 (Case No. 04) stated that PT. JICT is
legally and cobvincingly proven to have violated Article 17 Paragraph (1) that PT.
JICT as a business actor is proven to exercise control over the production and
marketing of goods or services which may result in monopolistic practices or
unhealtihy. Article 19 letter by thet PT. JICT as a business actor has proven to have
condutied one or several activities either alone or with other business actors, in the of
hindering the consumers or customers of their competitors to not do business relation
with order business actors. Article 25 Paragraph (1) letters ( c ) that PT. JICT as a
business actor has proven to have used a dominant position erther direcly or
indirectly to inhibit other potential business actors as competitors to enter the relevant
market Wibowo S Wirjaya is legally convinced to have violated Article 26 letters (a)
namely to double position as President of the Director in 2 (two) companies having
an influence in the same relevant market, namely PT. JICT and OTP have violated
the Monopoly Law.
