Aspek Hukum Pidana Terhadap Pengadaan Barang dan Jasa Konstruksi Dalam Proyek Pemerintah di Kabupaten Banggai Kepulauan

The research aims to: 1) To find out and explain how the terms and
procedures for the procurement of goods and services for government projects are
specified in the prevailing laws and regulations in Indonesia. 2) What is the
system for preventing and prosecuting corruption in the procurement of goods
and services for government projects.
Methods The research was conducted using a normative-doctrinal method
as well as a socio-juridical approach. This approach conducts an assessment of
the laws and regulations. The types of legal materials used in this study are
primary legal materials and secondary legal materials. Primary Legal Materials
Analysis of legal materials uses prescriptive analysis. The results of the study
show: 1) Consideration of the Legal Decisions of the Palu High Court Judges by
looking at the aspects of legal objectives, namely Justice, Benefit and Certainty;
2) socio-juridical Based on the applicable laws and regulations to the Presidential
Regulation as well as the regulation of the Minister of Public Works and Public
Housing which also applies to the LKPP regulation.
Conclusions and suggestions that the terms and procedures for the
Procurement of Goods and Services as stated in the regulations must have been
systematically regulated through applicable laws and underwent a significant
reform process through Government Regulation Number 12 of 2021, Minister of
PUPR Regulation Number 14 of 2020 and Institutional Regulation Number 12 of
2021, where the functions and authorities of the PPK are good.
Keywords: That the regulatory reform on the procurement of goods and
services and the technical implementation of the procurement of goods and
services are in accordance with the mechanism and process of prevention and
prosecution of criminal acts of corruption, prioritizing advocacy and early
prevention.
